We hear from lots of GCs and legal teams who'd like to have a clear process for team members to determine which matters work should be outsourced and which should be kept in-house.

Often, work ends up stuck in the "in" tray when it could be done more effectively and efficiently by an external specialist, or money is wasted on law firms when internal expertise could have been better utilised.

With an ever increasing demand on in-house legal teams, it pays to spend a few minutes each time a new project or piece of work comes across your desk to ask yourself honestly how you should approach it.

As with any framework, it's best to take the broad concept and tailor it to your own team, but if outsourcing appears to be the best way forward, then you should ask yourself these 6 key questions...

Outsourcing: Who's best placed?

If the decision tree outcome is to instruct external counsel, then ask yourself 6 core criteria questions to make sure the external adviser is the right one for your team and your project: 

PS. If they score less than 13 points in total, they may not be the best outsourcing option for a piece of work. Key 1 = No, 2 = Not Sure, 3 = Yes

1) Capability: Do they have a demonstrable track record in the area?

Quality: Can we trust them to deliver quality work or will it require significant oversight and input from us?

3) Cost certainty: Do they give us cost certainty? Do they have a tendency to scope creep?

4) Value: Are they good value for money?

5) Responsiveness: Will they be responsive, especially if the work is urgent?

6) Commercial and Cultural fit: Do they appear to align with our values? Are they pragmatic and commercially minded in their advice?
